Terms of Service -- Celuvra

These Terms of Service ("Terms") govern your access to and use of Celuvra (the "Service"), operated by Smart Technology Investments LLC ("Company," "we," "us," "our"). By using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Celuvra, you represent that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to comply with them.

2. Description of Service

Celuvra uses publicly available actuarial data from SSA, CMS, CareScout, and HHS/ASPE to model long-term care costs and compare LTC strategies (buy LTCI, self-insure, hybrid). The Service provides Monte Carlo simulations, Markov health state modeling, and strategy comparison reports. The Service is informational only.

3. Not Insurance or Actuarial Advice

Celuvra is not a licensed insurance broker, agent, or actuary. The strategy comparisons and cost estimates are based on publicly available data and actuarial models. They do not constitute recommendations to purchase, decline, or modify any insurance policy.

You should always:

Consult a licensed insurance agent for personalized LTCI advice
Consult a financial advisor about self-insurance strategies
Verify policy details directly with insurance carriers
Review all policy documents before purchasing

4. Data Accuracy Disclaimer

Our cost estimates are derived from SSA life tables, CareScout/Genworth cost-of-care surveys, HHS/ASPE LTSS projections, and state insurance filings that update on their own schedules. We do not guarantee the accuracy, completeness, or timeliness of data from third-party sources.

Cost estimates are probabilistic, not guarantees. Monte Carlo simulations show probability distributions, not certainties. Your actual experience may differ.

5. Permitted Use

You may use the Service for lawful personal or commercial research purposes. You agree not to:

Reproduce, resell, or sublicense our analysis outputs without a commercial license
Scrape or systematically extract data beyond API rate limits
Represent our data as official government or actuarial data
Attempt to reverse-engineer our models or methodology

6. Credits and Billing

Celuvra uses a per-report credit system. Credits are purchased as one-time payments via Stripe. Single reports cost 1 credit ($14), report packs provide 5 credits ($34), and API credit packs are available for developers. All fees are in U.S. dollars and are non-refundable except as required by applicable law.

7. API Access

API subscribers receive access subject to rate limits specified in the API documentation. API credentials are non-transferable. We reserve the right to suspend API access for abuse.

8. Intellectual Property

The Service, including its design, actuarial models, software, and compiled data outputs, is owned by Smart Technology Investments LLC and protected by copyright. The underlying government datasets are in the public domain. Our original analysis and methodology are proprietary.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART TECHNOLOGY INVESTMENTS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms are governed by the laws of the State of California. Any dispute shall be resolved by binding arbitration in Los Angeles County, California.

12. Changes to Terms

We may update these Terms at any time. We will provide at least 14 days' notice of material changes. Continued use after changes constitutes acceptance.
